If you have decided to divorce, or have been separated from your spouse - then you will want to find the right lawyer to protect you. While some divorces go smoothly, without the need for a lawyer - for the most part a lawyer is needed. With so many things to consider, like property settlement and even custody of any children, lawyers are a good idea.

How do you find one that is right for you? It takes a bit of effort to be sure. There are many lawyers out there with varying skills and specialties. Sorting through them will take time and some research. Of course, if you know of someone who has gone through a divorce themselves, then you could ask for a recommendation.

You can start by looking through the yellow pages, at least to find a few names you can check out. Do not just pick the first one you come to. They may be a good lawyer, but they may not specialize in divorce - or have your best interests at heart. It's a good idea to make a list of lawyers in your area. Give them a call asking them a few questions about their field of expertise.

Once you have at least three lawyers you feel could be the right fit for you, schedule a consultation. It's a good idea to have the option of more than one lawyer - you need to get a feel of whom might be best for you. You will want to find out what their rates are and compare them. Plus, how they may handle your case. You need to feel comfortable with whomever you decide will represent you. Asking about their experience, and if they have had their entire career in your state is a wise idea. You will want to know if they have the knowledge of your state's laws. Another plus is if a lawyer has had courtroom experience. Not all lawyers possess this and it's a great asset to have.

At your consultation, you will want to ask questions that are relevant to you. For example, you can learn about the divorce laws of your state, child custody laws and even get some good advice about divorce. If possible, couples can divide assets and settle on child custody through mediation.

In some instances though, the case must go before the courts and they will decide how it is to be done. Depending on your circumstances, and how complicated your case is, it could take some time to get resolved. A lawyer's fees will vary case by case. To prevent any surprises in the future, it's a good idea to ask about whatever fees are applicable during the consultation. You should also know who is responsible for paying them, and when they are to be paid. If considerable time will be spent on your case, the fees will generally be higher. If the case is settled out of court, you can be assured you will not be paying as much.

Once you have selected which attorney you wish to use, you will sign a retainer agreement. This is simply an agreement of what services are being offered and what rates will be charged. A copy of this agreement will be kept in the lawyer's office and one will be given to you. Make sure when you speak with your lawyer, you tell them everything you expect out of their services. It does no good to let them take the lead, as they only go by what the law says. If there is anything you wish for them to make sure of on your behalf, you will have to tell them. You need to keep a good relationship with your lawyer, and keep them informed of any developments.

The main thing to remember is, find a lawyer you like. You will be working with them through some difficult times, and you will want one you trust and get along with. If you find the lawyer you chose is not the right one, then move on before you sign a contract with them. Finding the wrong lawyer can lead to many problems down the line.
