The length of time a divorce will take to become final will vary depending on the type of divorce. Of course uncontested divorces will be quicker, this is not always an option. Many people do not wish to divorce and will fight their partner even if they emotionally know the marriage is over. Other factors such as child custody could be a reason a divorce will take longer than normal.
Before a couple can apply for divorce, they must be separated for at least a year - but this varies from state to state. It is always a good idea to find out what your state requires before beginning the process.
If there are issues like child custody, property division and any other assets to separate - it is a good idea to sit down and try to make this as fair as possible before taking it to court. The more prepared you are ahead of time, the less time it will take for your divorce to be final.
If the divorce is contested - it can take up to 2 years to be finalized, especially if there are many issues to work through. Uncontested divorces can take 3 months depending on how many cases the courts are hearing at any given time. Backlogs will slow down your divorce.
A divorce will become final when all issues have been agreed on and a judge decrees it final - even uncontested divorces must be heard before the courts.
The length of time depends on your state - some will be quicker than others. Research is the key to making your divorce as swift as possible. Resolving issues beforehand and being prepared for court will also help.
