What is an uncontested divorce and does it mean there will be no problems? Well not necessarily; just because the divorce is uncontested doesn’t mean you won’t run into some problems. Many people believe that uncontested means that only one partner is involved in the process, but this is not true. Both partners are involved and both agree to the terms of the divorce.

Just because partners agree to the divorce doesn’t mean they will agree on all terms involved. There are rare cases when the couple agrees on everything but this isn’t normally the case. Usually they will have to iron out details either between themselves or through mediation. If the couple are able to get all issues resolved without the help of the courts, it’s considered an uncontested divorce.

When a divorce settlement is agreed on by mediation the process is similar to that of collaboration. A third party is involved to help the spouses compromise and reach an agreement on their issues. With collaboration, both parties bring their own lawyers to help resolve any issues that need to be looked at. The main idea though is this process does not go to court - it is kept between the spouses.

Many issues need to be resolved during a divorce like property division, finances, child custody; any child and spousal support issues also must be resolved. Sometimes property division is done where both partners get equal share of the assets, while other times an agreement can be made on how to split things.
